Constitutional Law has undergone many changes since post World War II and its reflex has been felt in all other legal areas. However, little attention has been given to Legal Theory after these constitutional transformations. The present study discusses multiple aspects of such implications. After presenting what is understood by neoconstitutionalism, a correlation is drawn with changes in constitutional interpretation. A new element – defeasibility – is then placed as a necessary counterpoint between deliber- ating constitutional principles and the theory (...) of norms. Only if we take defeasibility into account and understand that constitutional interpretation has undergone certain changes, one is able to grasp the important tenets of neoconstitutionalism.Resumen:El derecho constitucional ha sufrido muchos cambios después de la Segunda Guerra Mundial y sus consecuencias se han manifestado en otras áreas del derecho. Sin embargo, poca atención se le ha dado a la teoría jurídica después de estos cambios constitucionales. Este estudio investiga varios descubrimientos de estas implicaciones. Después de presentar lo que se entiende por neoconstitucionalismo, se avanza una correlación con los cambios en la interpretación constitucional. Un nuevo elemento —derrotabilidad— se presenta como una contrapartida necesaria entre la deliberación de los principios constitucionales y las enseñanzas de la teoría de las normas. Sólo a través de la derrotabilidad y el entendimiento de que la interpretación constitucional ha sufrido ciertos cambios, puede uno entender uno de los grandes postulados del neoconstitucionalismo. Changes in the past two decades of goals for science education in schools have induced new orientations in science education worldwide. One of the emerging complementary approaches was the science-technology-society (STS) movement. STS has been called the current megatrend in science education. Others have called it a paradigm shift for the field of science education. The success of science education reform depends on teachers' ability to integrate the philosophy and practices of current programs of science education reform with their existing (...) philosophy. Thus, when considering the STS approach to science education, teacher beliefs about STS implementation require attention. Without this attention, negative beliefs concerning STS implementation and inquiry learning could defeat the reform movements emphasizing STS. This article argues the role of STS in science education and the importance of considering science teachers' beliefs about STS in implementing significant reforms in science education. (shrink)

This paper elaborates on the link between different types and degrees of experience that can be gone through within a form of life or collectivity—the so-called levels of immersion—and the development of distinct types of tacit knowledge and expertise. The framework is then probed empirically and theoretically. In the first case, its ‘predictions’ are compared with the accounts of novices who have gone through different ‘learning opportunities’ during a pre-operational training programme for running a huge nickel industrial plant in Brazil. These are also analysed vis-à-vis the experience of an expert who has designed and experienced the outcomes of two pre-operational training sessions in the nickel industry before developing and managing the one discussed here. Theoretically, the framework is used to pinpoint exactly what interactional experts who have developed their expertise through linguistic socialisation alone are able to do as well as to analyse the case of technical connoisseurs. The results indicate that the proposed framework is useful. It supports the design and improvement of training programmes for the development of tacit knowledge while at the same time bringing about a refined analysis of claims concerning the abilities of types of experts and expertise. The COVID-19 outbreak required diverse strategies, such as social distancing and self-isolation, to avoid a healthcare system crisis. However, these measures have been associated with the onset or increase of anxiety and depression symptoms in the population. Music listening was previously shown to regulate emotion, consequently reducing depression symptoms. Since previous studies with Brazilian samples have already shown a high prevalence of depressive symptoms during the first confinement period, the aim of this study was threefold: (i) to compare groups with (...) severe depression symptoms and no depression in what concerns to demographic and socio-economic factors as well as symptoms of anxiety and resilience levels, (ii) to explore changes in music listening daily routine during the confinement measures by both groups (no depression and severe depression), and (iii) to investigate which were the main factors influencing both two groups to music listening during the COVID-19 pandemic. This cross-sectional study included 494 Brazilian respondents aged 18 years and above. Our online survey comprised demographics, socio-economic, and COVID-19 related questionnaires, with questions regarding music listening used during social distancing measures on which the participants rated how much each of the 41 potential reasons for listening to music changed in importance compared to the situation before the pandemic and also the evaluation of anxiety, depression, and resilience levels. The respondents with severe depression were younger and showed higher levels of anxiety symptoms and lower resilience level. Furthermore, they were increasingly likely to listen to music to feel emotionally better with the situation, to feel comfort, to forget problems, to be energetic, to decrease sad feelings, to relax, to cheer up, to forget concerns, to express feelings, to reduce anxiety, to remember better times, to relieve boredom, to mentally stimulate themselves, and to ward off stressful thoughts compared to the participants with no depression. The exploratory factor analysis (FA) identified four types of music listening functions during social distancing measures: negative mood management, cognitive functioning, positive mood management, and physical involvement, in which the participants with severe depression revealed significant differences compared to non-depressed participants for the negative mood management factor, which shows the importance of music listening to regulate their negative emotions. As a conclusion, we can argue that most of our respondents used music listening to cope with and regulate their moods during confinement, especially those who presented with severe depression symptoms. While contemporary readers may find what appear to be appealing streaks of liberalism in Montaigne's 'Essays', I argue that a more careful analysis suggests that Montaigne's overall stance is quietistic and conservative. To help support this claim I offer a close reading of 'Essays' III.11 ("Of Cripples"), where Montaigne offers his famous critique of the witch trials of early modern Europe. Once Montaigne's objections to the witch trials are properly understood, we see that Montaigne did not seriously or consistently dispute (...) the church's authority in political matters, though certain undeveloped seeds of liberalism do leave an unresolved tension in his writings. The surprises occur at several levels, beginning with the very titles of his essays, which frequently have little to do with the topics he actually discusses. Who, (...) for example, would expect an essay titled "Of Three Good Women" (II.35) to praise the three women for their variously successful attempts at committing suicide—and little else? Or who would expect an essay with the innocent title "On Some Verses of Virgil" (II.5) to be richly confessional, as well as very explicitly sexual? Or, as one final example, who would expect an essay "Of Cripples" (II.11) to either (a) discuss the witch trials or (b) discuss cripples principally in terms of whether the lame make better sexual partners?The surprises are not confined to the formal features of Montaigne's text, but also appear in the views he articulates. We would not expect an early modern Frenchman to write so sympathetically and even admiringly about the cannibals of the New World (I.31). Nor would we expect an early modern French Catholic to write in opposition to the witch trials. Montaigne does both—with incredible finesse. But despite the attractively progressive attitude seemingly manifested in these two stances, Montaigne's overall view is in fact far more conservative and quietistic than we might expect, were we judging based only on these few cases. And so he surprises us yet again: We are surprised to find him opposing the witch trials, and we are surprised a second time to find that his opposition does not signal any deeper tendency toward progressive or politically liberal views. In short, there is good reason [End Page 235] to see Montaigne's general stance as firmly traditional. While he sometimes expresses apparently progressive views, he does so in a way that has no stable basis in his overall conceptual scheme, as I will argue. Of course, merely observing this tension in Montaigne's work is nothing new. Hugo Friedrich, writing in 1949, and discussing II.11, claimed that "Montaigne bravely takes a position against the delusion of the masses and against clerical fanaticism."1 But in the same passage (and elsewhere) Friedrich shows himself to be well-aware that this apparent radicalism is balanced by Montaigne's conservatism.2 That tension—in a nutshell—encapsulates the debate.3 However, "Of Cripples" presents this tension in its most perplexing form, making a detailed analysis of II.11 our best hope of making progress on the debate.4To support these claims I propose to offer a careful textual analysis of Montaigne's discussion of the witch trials in "Of Cripples."5 After considering several philosophical interpretations of his key Augustinian principle, I will argue that Montaigne's critique of the witch trials is primarily driven by problems internal to the religious perspective, and so does not represent an attempt to circumscribe the authority of religion in the public sphere more generally.6 Such a position, then, is both traditional and quietistic—another of Montaigne's surprises for his readers. If this is correct, then one of the principal texts used for promoting a "liberal" Montaigne—namely, II.11—can be be reappropriated by the defenders of a "quietistic" Montaigne. Nonetheless, even on my reading, there remain some incompletely resolved tensions. That, perhaps, is no less than we should expect from history's only self-proclaimed "accidental philosopher."7IMontaigne opens "Of Cripples" by discussing the Gregorian reform of the calendar, which had been adopted in France in 1582. Yet as odd as this opening is, it serves to quickly introduce a familiar theme in the Essays: Even so basic a matter as the calendar is subject to "[s] o much uncertainty"—just like everything else—that "we are every day in doubt" about how to "keep a record of past events" (F, pp. 784–85). A collection of personal narratives and essays, Living Professionalism is designed to help medical students and residents understand and internalize various aspects of professionalism. These essays are meant for personal reflection and above all, for thoughtful discussion with mentors, with peers, with others throughout the health care provider community who care about acting professionally.

In this paper I intend to thoroughly analyse Karl Popper’s relation to metaphysics. I start with his first writings, where he states the differences between science, pseudoscience and metaphysics. I then describe how his thoughts on the subject evolved to culminate in his reflection on metaphysical research programmes and the need for a revival of natural philosophy. A major concern is Popper’s famous testability criterion to set apart science from non-science. I point at the problems of the conception of metaphysics (...) as non-testable theories and, in order to avoid these problems, I propose to retain nothing but the traditional conception of metaphysics as the general theories about the nature of the world. This leads me to the conclusion that science is not only an empirical task but also, and in a very important sense, a speculative one. (shrink)

Memento mori, the admonition to remember death, can take many forms, but the idea remains the same, namely that an awareness of our inevitable end should bear on how we live. I show how Richard Linklater’s warning works in each of the movies and argue that with the Before trilogy he makes a Frankfurt-style case that romantic love is life’s summum (...) bonum--i.e. "the ultimate ground of practical rationality.". É no espaço e no tempo das suas múltiplas viagens que Weiss diagnostica e espelha a relação de Alteridade Ocidente / Oriente, entre a Europa e o Outro. Este artigo pretende mostrar e propor adaptações metodologias centradas na abordagem comunicativa, usando metodologias ativas e as ferramentas TIC para facilitar o ensino-aprendizagem de PLE a deficientes visuais espanhóis. Dada a natureza e índole de caráter introdutório, panorâmico, sistemático e claramente didático deste trabalho, o leitor poderá ter uma compreensão direta e científica do mundo educativo que rodeia o educando deficiente visual.A metodologia utilizada neste trabalho foi quantitativa e qualitativa, a abordagem foi respaldada em bibliografia pertinente e em dados empíricos (...) coletados pela pesquisadora por meio de entrevistas com diretores, coordenadores, docentes. Após as observações e entrevistas foram desenvolvidas e adaptadas algumas metodologias para após serem aplicadas aos alunos dos distintos centros de reabilitação e por último foi feita a análise dos resultados obtidos. We are mastering engineering behaviour on a molecular level. A growing number of researches investigating the relationship between microbiota, human brain and behaviour examine the impacts of manipulating specific microbial colonies in human hosts. To enable discussing and understanding communicational phenomena that occur in scales not visible to the naked eye, we propose the term Molmedia – a metaphorical reference to the concept of mole, denoting here not exclusively the quantitative amount of substance but the information exchange processes (taking the (...) substances as messages) that are going on at elementary entities level such as atomic, subatomic and molecular, within a given system that can be a living organism. We take media (plural of medium) as an intervening agency, means or instrument. Interacting emitters and receivers in this system are the microbiota and the organism actual cells. Within this self-organizing structure, the ongoing informational processes produce, as an emergence, the self and behavioral patterns that can be appreciated, manipulated and cannibalized. The art and science installation Transplanting the Self: Microbiome Anthropophagy is presented as an explorative exercise of the concept and related possibilities in science concerning gut–brain communication and the use of neuroregenerative nutrition in treatments for neurologic conditions. Este texto situa-se no domínio da História das Ideias e aborda como temática principal o pensamento de Oliveira Martins sobre o Homem negro e a escravatura. As fontes primárias privilegiadas foram os documentos escritos do pensador, escolhidos pela sua representatividade quanto ao ideário em causa, a par de historiografia sobre a temática visada, que é muito vasta em termos biográficos e parcelares. Para o estudo das ideias do autor utilizámos metodologias e técnicas de análise interdisciplinares. A contextualização histórica, como ponto (...) prévio à abordagem do tema central do trabalho, é delineada a partir de uma breve caracterização das diversas conjunturas económicas, políticas e sociais da época, uma vez que as ideias não têm validade absoluta, fora do tempo e do espaço em que são geradas. Procurou-se expor e analisar a coerência entre as ideias de Oliveira Martins acerca da História, da Sociedade, da Nação e do Estado e as suas concepções antropológicas e rácicas; por fim, os seus conceitos sobre a impossibilidade de “civilizar” o Homem negro e sobre a escravatura. O presente artigo discute possibilidades de articulação da dimensão multicultural na perspectiva do professor e da juventude, analisando implicações para o ensino na escola. Utilizei como fonte o Banco de Teses do site da Capes. O objetivo foi pensar como a epistemologia multicultural pode contribuir à identidade juvenil de maneira positiva. O eixo principal da interrogação está na dualidade diferença/ igualdade na luta contra preconceitos e estereótipos. A pesquisa indica limites e potenciais nas mudanças curriculares numa perspectiva multicultural crítica. Contudo, (...) a prática monocultural é um problema educacional e social que tem raízes históricas. Concluo que é possível pensar um ângulo multicultural na educação com a juventude. Nesse ponto de vista, uma pista pode ser o papel da pesquisa multicultural na formação do professor e no currículo. (shrink)

Este trabalho pretende comentar a doutrina que Merleau-Ponty expõe, em seus distintos períodos, sobre o que caracteriza a obra clássica e sua interpretação. Aponta-se como pressupostos dessa doutrina a admissão de uma certa filosofia da linguagem, bem como de uma particular teoria da produtividade. Em função disso, pergunta-se se, efetivamente, foi feita, ali, uma crítica radical da "filosofia da consciência", como usualmente se supõe.  .

In this article we examine the true scope of the right Hobbes recognizes, even for the subjects of a State, to life. We hold that the right to live includes the subject's right not to accept to be deprived not only of life but also of limb; a right not to have to kill; a right not to accept to be imprisoned. The sovereign of course has a right to kill, mutilate and arrest but the conflict of his right and (...) the subject's is an original feature of Hobbes's political thought, not to be found for instance in Locke's. Also, since life is motion and desire is a continual progress from one object to another, the mere survival of the subject is not enough to make him content once peace has been achieved. The expression of the subject's discontent is illegal, but it may happen since we can understand the right to live as a right to an ever more ambitious desire. The ruler who wants to avoid discontent and its uncivil effects should in a certain measure pave the way for economic development, in order to permit the subjects to at least partially attain their desire. Obviously this is not a moral duty of the sovereign, but a prudential one, if he does not want to risk losing his office. (shrink)

Depois, aprofundando a questão da narrativa na teologia e no pensamento de MacIntyre. Resumo: O presente artigo reflete sobre o tema da “responsabilidade” no pensamento filosófico de Hannah Arendt (1906 - 1975) e Emmanuel Lévinas (1906 - 1995) com a intenção de demonstrar as nuances e particularidades de cada autor e ao mesmo tempo realizando uma atualização da reflexão filosófica destes dois grandes pensadores do século XX. Para Arendt, o conceito de responsabilidade perpassa tanto o aspecto pessoal quanto coletivo acentuando a dimensão da política e aparece de forma sistemática em escritos a partir (...) do seu livro Eichmann em Jerusalém (1963). Já para Lévinas, o conceito de responsabilidade está intrinsecamente ligado à sua concepção de ética como filosofia primeira. Encontramos uma maior exposição deste conceito nas obras Totalidade e Infinito (1961), Ética e Infinito (1982), Deus, a Morte e o Tempo (1993), dentre outras. Ele tem por objetivo tirar a primazia da ontologia e assim propor um novo paradigma para o agir humano. Segundo Lévinas, a exterioridade do rosto manifesta-se quando o outro olha para mim, torno-me responsável por ele, de tal maneira que, mesmo tendo que assumir responsabilidade a seu respeito, a sua responsabilidade incumbe-me, ou seja, o rosto do outro me interpela, me prende em sua ética da responsabilidade. Podemos afirmar que há uma aproximação entre o pensamento de Hannah Arendt e Emmanuel Lévinas, na concordância de ambos, no fato de que não deve haver uma supervalorização do ‘eu’, mas a centralidade deve estar acentuada na alteridade, quer no cuidado com o mundo (Arendt), quer no cuidado com o Outro (Lévinas). The dream is contextualized through Gamow's extended scientific work and popular scientific efforts, and in light of enduring preoccupations with the notion of a complete science. The analysis extends to an examination of the relationship of the dream to dreaming practices and deliberations apart from Gamow’s, as evident in the relationship and collaboration between the physicist Wolfgang Pauli and C. In a detailed and spirited critique, Professor James M. Humber has found my defence of the ontological argument unconvincing. Humber's case rests upon his claim that my ‘error’ is due to my ‘having accepted an incorrect definition of “physically necessary being” … ’. Now I do indeed claim that God must be conceived as a factuall necessary being, i.e. as eternally independent. I take the notion of God's aseity or eternal independence to be relatively straightforward and uncontroversial; it is accepted (...) as an essential component of the concept God by many philosophers who also insist that there is no acceptable form of demonstrative theism. Thus, it is widely held that ‘God is a factually necessary being’ does not imply ‘God is a logically necessary being’; that God is eternally independent does not imply that he exists in all possible worlds. But it is precisely this view that I have argued is incorrect. While I concur that there is an intelligible concept of God as factually necessary, I deny that the existence of such a being is logically contingent, a mere matter of empirical fact. Indeed, a rigorous inspection of the concept of an eternally independent being reveals that whether that concept is instantiated, i.e. whether there exists a being exemplifying that concept, is knowable a priori . My claim is in fact stronger than this. I argue that the existence of an eternal, independent, omniscient and omnipotent being is demonstrable by conceptual analysis. It is Humber's contention that my alleged demonstration of God's existence crumbles upon the discovery of the unacceptability of my definition of ‘factually necessary being’. Let us see. (shrink)

O debate teológico presente no Stift de Tübingen é campo de recepção da filosofia kantiana por meio de uma questão específica: aquela da existência de Deus e de Sua revelação aos homens. Reconstruindo-o tangencialmente, pode-se sublinhar qual a posição que a filosofia kantiana ocupa nele, salientando-a frente àquela de Storr e Flatt. Também, apontar para a apropriação dela no seio daquele debate. Assim, quando se volta para a posição de Hegel, nota-se que ele se contrapõe à apropriação teológica de Kant, (...) posicionando-se de modo similar ao kantiano. Tem-se aqui um liame entre Kant e aquilo que se chama, incipientemente, de filosofia hegeliana. (shrink)

As future citizens, students must make decisions requiring an understanding of the interaction of science and technology and its interface with society. STS education has been strongly identified with meeting this goal, but putting theory into practice has so far been difficult. This article asks, “What are the challenges influencing science teachers to implement STS education in the science classroom?” The author investigated using a mixed method research technique incorporating multiple sources of qualitative and quantitative data (questionnaire, interviews, field notes, (...) and classroom observations). Constraints a fecting teachers' practices in teaching science through STS education were identified and can be categorized into impersonal, interpersonal, and personal constraints. Findings indicated interactions within and between external and internal constraints. Suggestions are made for implementing change in various aspects of science teacher education. (shrink)

As diminutas notas para si mesmo e as pinceladas sinuosas de uma pintura de Van Gogh descortinam uma investigação tateante sobre o problema da não-figuração (que Salomão designa como abstração) nas artes e sobre o trabalho psíquico do sintoma: cerne da subjetividade, (...) deiscência existencial e origem do discurso, conforme pensou Lacan. In this paper an Artificial Neural Network (ANN) model, for predicting the category of a tumor was developed and tested. Taking patients’ tests, a number of information gained that influence the classification of the tumor. Such information as age, sex, histologic-type, degree-of-diffe, status of bone, bone-marrow, lung, pleura, peritoneum, liver, brain, skin, neck, supraclavicular, axillar, mediastinum, and abdominal. They were used as input variables for the ANN model. A model based on the Multilayer Perceptron Topology was established and trained using (...) data set which its title is “primary tumor” and was obtained from the University Medical Centre, Institute of Oncology, Ljubljana, Yugoslavia Test data evaluation shows that the ANN model is able to correctly predict the tumor category with 76.67 % accuracy.
